By using the Smowka platform, the user acknowledges and agrees to the following terms and conditions. Smowka is a digital marketplace that facilitates connections between consumers and independent partner businesses, including but not limited to tobacco shops, liquor stores, markets, and bars. Smowka operates solely as a technology intermediary, providing a virtual environment for users to browse products, place orders, and choose the method of fulfillment, which may include delivery, in-store pickup, or on-site consumption. Smowka does not produce, store, sell, handle, or deliver any products listed on the platform.

All products and services available through Smowka are offered and fulfilled exclusively by independent third-party businesses (vendors) that operate under their own commercial responsibility and in compliance with all applicable local, state, and federal laws and regulations. Vendors are solely responsible for the accuracy of product descriptions, availability, pricing, offers, and promotions displayed on the Smowka platform. Furthermore, vendors are fully responsible for the preparation, packaging, storage, quality, safety, labeling, and delivery of all products. Smowka does not assume any responsibility for the legal compliance, safety, or quality of any product offered by vendors through the platform.

Delivery times, service areas, fees, and fulfillment methods are established and managed directly by each vendor. Smowka does not guarantee delivery times, availability of delivery, or the successful completion of any order. Users acknowledge that any issues related to delays, missing items, damaged goods, incorrect deliveries, or dissatisfaction with the products or services received must be addressed directly with the responsible vendor. Smowka will, when possible, facilitate communication between the user and the vendor to assist in the resolution of disputes, but ultimate responsibility lies with the vendor.

All payments processed through the Smowka platform are transferred to the respective vendor, minus any service or transaction fees agreed upon between Smowka and the vendor. Smowka does not act as a seller, distributor, or logistics provider. The role of Smowka is strictly limited to enabling the transaction by providing a user-friendly digital interface for order placement, payment processing, and communication. In cases where payment is made directly to the vendor outside the Smowka platform, Smowka bears no responsibility for any financial transaction, refund, or chargeback.

Users understand that Smowka is not liable for any direct, indirect, incidental, consequential, or punitive damages that may arise from the use of the platform, including but not limited to delays, product defects, delivery failures, miscommunications, or issues related to vendor performance. Smowka disclaims all warranties, express or implied, related to the goods and services provided by vendors, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

By using the Smowka platform, users confirm that they are of legal age for the purchase of any restricted products, such as tobacco, alcohol, or other regulated goods, in accordance with the laws of their jurisdiction. It is the sole responsibility of the vendors to verify the age and identity of customers where required by law, both at the point of sale and at the time of delivery or pickup.

Smowka reserves the right to modify, update, or discontinue the platform, its features, or these terms and conditions at any time without prior notice. Continued use of the platform after such modifications constitutes acceptance of the updated terms. Users are encouraged to review these terms regularly to remain informed about any changes.

Smowka may provide customer support channels to assist users with platform-related issues, but this does not imply any liability for vendor performance or product satisfaction. All requests for refunds, exchanges, product complaints, or legal claims must be directed to the responsible vendor.

By creating an account or placing an order on the Smowka platform, users explicitly agree to these terms and conditions, confirming that they have read, understood, and accepted all clauses outlined above.
